Were you underpaid for overtime?

You likely expect to work the amount of hours you were hired to do. For the average American employee who works full-time, the typical amount of time worked in a week is around 36 hours or roughly 7 and a half hours a day. This average can go up or down depending on the kind of work an individual does and their job role. 

You may have, however, worked more than 36 hours this week. You may have worked so much that you may be entitled to overtime pay. Overtime pay is given to some employees who work more than 40 hours a week. Here is how much you should get:

What is the rate of overtime pay in California?

In California, overtime pay is given to employees who work more than 8 hours in a day, 12 hours in a day or into the seventh consecutive work day. 

For employees who work more than 40 hours in a work week, they are due one and one-half their typical rate for the extra time. Employees also make one and one-half their typical pay rate if they work more than 8 hours in a work day or for the first 8 hours on the seventh consecutive work day. Employees who work past 12 hours in a workday are paid double their typical pay. The pay is doubled if the employee works for more than 8 hours on the seventh consecutive work day. If you did any of this, then you should expect to receive overtime pay.

What if you did not get overtime pay?

If you worked enough to earn overtime pay but find your paycheck lacking any differences, then you could be a victim of wage theft. Employers may steal from their employees by not paying overtime, misclassifying employees or asking employees to work off the clock. However, you can take legal action to pursue your overtime pay.
