Discrimination related to job assignments and promotions

An employee can be discriminated against when it comes to job assignments and promotions. You should be concerned if your employer is making decisions regarding duties and promotion opportunities based on race, color, religion, gender identity, sexual orientation, pregnancy, national origin, age, disability or genetic information.

Here is how this form of discrimination can happen:

Unfair shift assignments

It’s unlawful for an employer to give preference to employees of a particular identity attribute during shift assignments. You may be experiencing discrimination if you are always put on shifts that are considered unfavorable, such as late nights and weekends. 

Segregated from other employees or customers

If your employer keeps giving you duties that do not involve interacting with other employees or customers, you may need to be concerned. They may also be discriminating against you if they deny you the opportunity to participate in training or other programs.

Companies segregating employees can be subtle or obvious. It’s vital to always be on the lookout. Not being notified of a key meeting may not be an honest mistake.

Overlooked for several promotions

If your employer passes you over for several promotions in favor of employees of a particular race, national origin, age or disability status, you may be experiencing discrimination. For example, if all the people being promoted are younger, chances are your employer is making promotion decisions based on age.

It may also be unlawful for an employer not to inform employees on leave, such as maternity leave, about promotion opportunities or to use non-inclusive language when describing the new role, discouraging some employees from applying.
