What meal breaks are required in California?

California labor laws provide specific requirements that employers must follow for their employees. One of these is that they are required to provide meal breaks for employees so the workers have the opportunity to eat during their shift. 

Employers and employees should understand the requirements for meal periods. This can help to ensure employees always receive the breaks they’re due.

Meal periods depend on hours worked

Meal periods are required for any employee who works at least five hours. The employee can waive the meal period with the employer’s agreement if they don’t work more than six hours. 

A second meal period is required for employees who work at least 10 hours. One of the two meal periods can be waived as long as the person doesn’t work more than 12 hours. The employee must take at least one meal period if they work 10 hours or more. 

Most meal periods are unpaid

Meal periods are unpaid breaks as long as the employee is relieved of all work duties and is free to leave the work site. If the employee has to do any work, including something as minor as answering the phone, the entire meal period must be paid. The same is true if they’re required to remain at the workplace during the meal period.
